Terms of service

These Terms govern this website and any quote, booking or service from Bali Luxury Charter Co. (PT Juara Holding Group). Visiting, requesting a quote or booking means you accept them.

Last updated May 2026 · Effective May 2026

01Definitions

“Booking”: a confirmed reservation, evidenced by deposit payment and our written confirmation.

“Client”: the natural or legal person entering into a Booking with us.

“Supplier”: the third-party operator (vessel owner, hotel, dive operator, transport company) that performs the on-the-ground service.

“Trip”: the travel programme described in your Booking confirmation.

02Our role

Bali Luxury Charter Co. acts as an independent travel curator and booking agent. We negotiate, coordinate and confirm services with the Supplier on your behalf.

The contract for the physical service (vessel charter, hotel stay, dive package, transfer) is between you and the Supplier, with us as booking intermediary. Where we are the Supplier ourselves, the Booking confirmation says so explicitly.

03Quote & booking process

Quotes are valid for 14 calendar days from issue unless stated otherwise.

A Booking is confirmed when (a) we issue a written confirmation, (b) we receive the agreed deposit and (c) the deposit clears.

The standard deposit is 30% at confirmation, with the balance due 60 days before the Trip starts. High-season or peak-date Bookings may require larger or earlier deposits, as stated in your confirmation.

04Payment

Payments are processed via Xendit, Midtrans or international wire transfer, in the currency stated on the invoice (USD or IDR by default).

The Client bears sender bank fees, recipient bank fees above our published charges, and currency conversion costs imposed by the Client’s bank or card issuer.

05Cancellation by the Client

More than 60 days before the Trip starts: the deposit is refunded, less a 10% administrative charge.

30–60 days before: 50% of the total Trip price is refundable.

15–29 days before: 25% of the total Trip price is refundable.

Less than 15 days before: no refund, unless the Supplier voluntarily offers one. No-show: no refund.

These percentages may be modified, and will then be stated explicitly, for high-season Bookings, special-charter Bookings, or bespoke vessels and villas with stricter Supplier policies.

06Cancellation or modification by us or the Supplier

If we or the Supplier must cancel for operational reasons (under-booking, vessel mechanical issue, hotel closure), we will offer (a) a full refund, (b) re-booking on equivalent dates without penalty, or (c) a comparable alternative at no additional cost.

We are not liable for consequential losses, such as flight rebooking, beyond the direct refund obligation.

07Force majeure

Neither party is liable for failure to perform because of force majeure: natural disasters (earthquake, tsunami, volcanic eruption, including activity at Mount Agung, Mount Rinjani, Mount Merapi or any active Indonesian volcano), severe weather, public-health emergencies, civil unrest, war, terrorism, government action including travel restrictions, port closures, harbour-master advisories, mandatory evacuations, or strikes by carriers or port authorities.

In a force-majeure cancellation we refund Supplier-recoverable amounts and use reasonable efforts to recover non-refundable ones. Non-recoverable Supplier costs (for example fuel pre-purchases and perishable provisioning) are not refundable to the Client.

08Insurance

Comprehensive travel insurance covering medical evacuation, trip cancellation, baggage and liability is required for all marine and remote-area programmes.

The Client must arrange adequate insurance and provide the insurance certificate before the Trip starts. We can recommend reputable providers but do not act as an insurance broker.

09Health, safety & passport

The Client must hold a passport valid for at least 6 months beyond the Trip end date, and any visa required to enter Indonesia.

The Client must tell us in writing of any medical condition, allergy, dietary restriction or mobility limitation that may affect the Trip.

For diving programmes the Client must hold a valid certification (PADI, SSI or equivalent), provide a current dive medical clearance where required, and follow safe-diving protocols, including conservative ascent profiles.

Children under 12 may face additional restrictions on certain activities, such as open-water diving or high-current snorkelling sites. The Client warrants compliance with these.

10Conduct on board and on site

The Client and their party agree to follow the lawful instructions of the Captain, dive master, hotel staff or driver.

We and the Supplier may end a Trip without refund where the Client’s conduct endangers safety, materially disrupts other guests or breaks Indonesian law.

Indonesian law strictly prohibits the consumption, sale or carriage of narcotics (Undang-Undang Narkotika No. 35/2009). Violations carry severe penalties under Indonesian criminal law.

11Limitation of liability

To the maximum extent permitted by Indonesian law, our liability for any direct loss is limited to the total Booking value paid by the Client.

We exclude liability for indirect, consequential or special losses, including but not limited to lost profits, lost holiday enjoyment and consequential travel costs. Nothing in these Terms limits liability for death, for personal injury caused by our gross negligence, or for fraud.

12Intellectual property

All content on baliluxurycharter.com (text, images, logos, video, layout) belongs to PT Juara Holding Group or its licensors and is protected by Indonesian copyright law (Hak Cipta, UU No. 28/2014) and applicable international copyright treaties. You may not reproduce, distribute or create derivative works without our prior written consent.

13Data protection

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms by reference.

14Governing law & jurisdiction

These Terms are governed by the laws of the Republic of Indonesia.

Disputes are first settled by good-faith negotiation. Failing that, the Client and Bali Luxury Charter Co. agree to binding arbitration before the Badan Arbitrase Nasional Indonesia (BANI) in Jakarta, conducted in English with one arbitrator under BANI Rules. Either party may seek injunctive relief from the competent Indonesian courts where strictly necessary.

15Severability & entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force.

These Terms and the Booking confirmation form the entire agreement between the parties and supersede all prior representations.

16Changes

We may revise these Terms from time to time. The version in force on the date of your Booking confirmation governs that Booking. Material changes are announced by a banner on the home page or by email.
